You'll be provided FTP access to our server, but will not have CGI access. If you have no web design ability contact us anyway. We may be able to help with the design to get you or your group online. |
SALEMPRIDE.COM FREE WEB PAGE TERMS OF SERVICE (TOS)
1. ACCEPTANCE OF TERMS
SalemPride.com provides free subdomain hosting subject to the following Terms of Service (TOS) which may be updated periodically. Please note that these TOS apply only to subdomain pages hosted on SalemPride.com.
2. DESCRIPTION OF SERVICE
In order to use the SalemPride.com free hosting service you must obtain your own access to the Internet. You must provide all necessary equipment and pay any service fees associated with your Internet access.
3. YOUR OBLIGATION TO PROVIDE ACCURATE INFORMATION
You agree to provide accurate and truthful information about yourself in all communications with SalemPride.com staff. SalemPride.com reserves to right to suspend or terminate any free hosting which has been obtained based on inaccurate information.
4. SALEMPRIDE.COM PRIVACY POLICY
We will not include personally identifying information about you to third parties except as authorized by you or as required by law.
5. MEMBER CONDUCT
You understand and agree that all information, data, text, software, music, photographs, videos and other files or materials contained on or transmitted from your web page(s) are your sole responsibility. This means that you and not SalemPride.com are responsible for any content uploaded to the SalemPride.com server.
You agree not to use the SalemPride.com free web page service to:
a. upload, post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b. harm or annoy minors in any way;
c. impersonate any person or entity, including, but not limited to, a member of SalemPride.com staff, or falsely state or otherwise misrepresent your affiliation with any person or entity;
d. upload, post or otherwise transmit any Content that you do not have a right to transmit such as proprietary and confidential information or under nondisclosure agreements;
e. upload, post or transmit any Content that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party;
f. upload, post or transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of unauthorized solicitation;
g. upload, post or transmit any material that contains software viruses or any other computer code designed to interrupt, destroy or limit the functioning of any computer software or hardware;
h. interfere with or disrupt the SalemPride.com service or servers, or disobey any requirements, procedures, policies or regulations of the free hosting service;
i. intentionally or unintentionally violate any applicable local, state, national or international law;
j. stalk or otherwise harass another;
k collect or store any unauthorized personal data about other users;
l. promote or provide information in support of illegal activities, promote physical harm or injury against any group or individuals, or promote any act of cruelty to animals;
m. use your home page as storage for remote loading beyond SalemPride.com;
n. engage in commercial activities without express approval from SalemPride.com. This includes, but is not limited to, the following activities:
offering any product(s) or service(s) for sale
soliciting for advertisers or sponsors
conducing raffles or any contest that requires an entry fee
displaying a sponsor or affiliate banner of any kind
6. SPECIAL GEOGRAPHIC LIMITATION
Free web pages are offered for individuals, groups or organizations located in or providing services to Salem, Oregon. You agree to abide by all laws and regulations in the United States of America, State of Oregon, City of Salem and any other applicable counties or local jurisdictions.
7. CONTENT SUBMITTED TO SALEMPRIDE.COM
SalemPride.com does not claim ownership of content you place on our server. By submitting content to SalemPride.com you grant us the right to the world-wide, royalty-free and non-exclusive license to publish the content solely for the purpose of displaying your uploaded pages. You acknowledge that SalemPride.com does not pre-screen content but shall have the right (but not the obligation) in our sole discretion to refuse service or remove any content that violates these TOS or is otherwise objectionable.
8. INDEMNITY
You agree to indemnify and hold SalemPride.com and its affiliates, staff, owners, employees, agents and other partners harmless from any claim or demand including attorney's fees made by any third party due to or arising from your content, your use of the free web page service, your violation of the rights of any other person or entity, or your violation of our TOS. You further agree that SalemPride.com will not be held liable for any interruptions in the service.
9. NO RESALE OF FREE WEB PAGE SERVICE
You agree not to offer any portion of this free hosting service for sale.
10. STORAGE CAPACITY AND LIMITATION OF SERVICE
Each SalemPride.com subdomain is allowed 15MB of disk space for web files. Free users will be provided FTP access to the SalemPride.com server, but will have no access to the CGI bin, MySQL databases, etc.
11. MODIFICATIONS TO SERVICE
SalemPride.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Yahoo shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
12. TERMINATION
You agree that SalemPride.com, at our sole discretion, may terminate your free web page and hosting without notice for any violation of our TOS. SalemPride.com may also for any reason quit providing the free hosting service. You agree that SalemPride.com shall not be liable to you or any third party for any termination of your access to the free web page service.
13. SALEMPRIDE.COM PROPRIETARY RIGHTS
You agree that the free web page service may contain proprietary and confidential information that is protected by applicable intellectual property laws. We reserve all copyright and trademark rights.
14. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:a. YOUR USE OF THE FREE WEB PAGE SERVICE IS SOLELY AT YOU RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SALEMPRIDE.COM DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED.
b. SALEMPRIDE.COM MAKES NOT WARRANTY THAT THE SERVICE WILL MEET YOUR NEEDS, THAT THE SERVICE WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED.
c. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE FREE WEB PAGE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM, OR LOSS OF DATA THAT RESULTS.
d. NO ORAL OR WRITTEN ADVICE OR INFORMATION OBTAINED BY YOU FROM SALEMPRIDE.COM SHALL CONSTITUTE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.
15. LIMITATION OF LIABILITY
YOU EXPRESSLY UNDERSTAND AND AGREE THAT SALEMPRIDE.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT INCIDENTAL , CONSEQUENTIAL OR EXEMPLARY DAMAGES INCLUDING DAMAGES FOR LOSS OF PROFIT, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF SALEMPRIDE.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES RESULTING FROM YOUR INABILITY TO USE THE SERVICE.
16. NOTICES
Notices to you may be made via either email or regular mail. SalemPride.com may also provide notices of changes to the TOS or other matters by displaying notices or links to notices at www.salempride.com/free-pages.htm.
17. COPYRIGHTS
SalemPride.com respects the intellectual property rights of others and we ask all users of our free web page service to do the same.18. GENERAL INFORMATION
The TOS constitutes the entire agreement between you and SalemPride.com and governs your use of the free web page service. The TOS and the relationship between you and SalemPride.com shall be governed by the laws of the State of Oregon. You and SalemPride.com agree to submit to the personal and exclusive jurisdiction of the courts located in the county of Marion, Oregon. The failure of SalemPride.com to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision. If any section of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeaver to give effect to the parties' intentions as reflected in the section, and other sections of the TOS shall remain in full force and effect. You agree taht any claim or cause of action arising out of or related to the use of SalemPride.com's free web page service or the TOS must be filed within one (1) year after such claim or cause of action arose, or be forever barred. The section titles in these TOS are for convenience and have no legal or contractual effect.
19. VIOLATIONS
Please report any violations of these TOS to our Webmaster.
